By accessing or using the website at www.mercedconcretecontractor.com (the "Site"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or request services from Merced Concrete. These terms apply to all visitors, users, and customers.
Merced Concrete provides residential and commercial concrete contracting services, including but not limited to driveway installation, patio construction, foundation work, sidewalk building, and decorative concrete, in Merced, CA and surrounding areas. The Site is intended to provide information about our services and allow potential customers to request estimates. Using the Site does not create a service agreement - a formal agreement is established only through a written estimate or contract signed by both parties.
All estimates provided by Merced Concrete are based on information available at the time of the site visit and the scope of work described. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
Pricing may change if the scope of work changes after an estimate is issued, if unforeseen site conditions are discovered during the project, or if material costs change significantly between the estimate date and project start. We will notify you in writing before proceeding with any work that would increase the cost beyond the original estimate.
Verbal estimates or ballpark figures are not binding. A written, signed estimate or contract is the only binding commitment of price.
Project scheduling is subject to availability, permit approval timelines, and weather conditions. We will provide a project start date once permits are approved and a deposit (if required) is received. Start dates may shift due to rain, extreme heat, or other conditions that make it unsafe or impractical to pour concrete.
If you need to cancel a scheduled project, please notify us in writing as soon as possible. Deposits may be non-refundable depending on how much work has been performed or materials ordered at the time of cancellation. Specific cancellation terms will be outlined in your written contract.
Merced Concrete reserves the right to cancel or reschedule a project due to weather, permit delays, material shortages, or other circumstances outside our control. In such cases, we will work with you to find the earliest available rescheduled date.
Payment terms are outlined in each written estimate or contract. Typical terms require a deposit before work begins, with the balance due upon project completion. Final payment is due at or before the time of project completion unless otherwise agreed in writing.
Accepted payment methods will be listed in your contract. Late payments may be subject to interest charges as specified in the contract. Merced Concrete reserves the right to suspend or stop work on a project if payment obligations are not met.
Under California law, you have certain rights regarding mechanic's liens. A licensed contractor who is not paid may place a lien on your property. We encourage you to review the "Notice to Owner" documentation provided with your contract.
Merced Concrete will obtain all permits required by local and state law for the agreed scope of work. Permit fees are typically included in the estimate or listed as a separate line item. The customer is responsible for obtaining any HOA approvals or neighbor notifications that may be required before work begins. We are not responsible for delays caused by HOA review processes or third-party approvals outside our control.
Merced Concrete warrants that all work will be performed in a workmanlike manner consistent with industry standards. Any specific warranty terms - including duration and coverage - will be stated in the written contract.
Concrete is a natural material that will crack over time. Hairline cracks along control joints are normal and expected. Our warranty covers defects in workmanship, not normal concrete behavior. It does not cover damage caused by tree roots, ground movement beyond reasonable expectations, improper use, or external impacts.
The Site and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components.
To the fullest extent permitted by law, Merced Concrete and its employees, agents, and contractors shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our services, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to our services shall not exceed the amount paid by you for the specific project giving rise to the claim.
All content on this Site - including text, images, logos, and design - is the property of Merced Concrete or its content providers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any Site content without our express written permission.
If a dispute arises between you and Merced Concrete, we ask that you contact us first at sales@mercedconcretecontractor.com or (209) 308-1587 to try to resolve it informally.
If we cannot resolve the dispute informally within 30 days, either party may pursue formal remedies. For disputes involving amounts of $12,500 or less, you may file a claim in California Small Claims Court. For larger disputes, the parties agree to binding arbitration in Merced, CA under the rules of the American Arbitration Association, unless both parties agree otherwise in writing.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes not resolved through arbitration shall be subject to the exclusive jurisdiction of the courts located in Merced County, California.
Merced Concrete reserves the right to update or modify these Terms and Conditions at any time. When we make changes, we will update the effective date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.
